My social security name, Driver's License, Tax forms, and every legal document here in the US is in my married name which is Maria Gracia Bautista Elliot.

Last year, when there was outreach by the Philippine consulate, I renewed my passport and was updated to Maria Gracia Reyes Elliot. I asked them if they can use my name as Maria Gracia Bautista Elliot to match my green card and documents here in the US but was told that I have to follow the Filipino way which is using my maiden last name (Reyes) as a middle name on my new married name.

Answer: Marriage certificates have different formats and in most cases, it is acceptable as proof of legal name change even without listing the new married name. This is because of the assumption that the woman takes the man's name following said marriage.

Please contact the NPIC at 1-877-487-2778 for a more thorough explanation as to why your marriage certificate was not accepted. Alternatively, you may submit a new application instead of a renewal. New applications do not need name change paperwork as long as you can provide sufficient identification documents bearing your current legal name.

Adding maiden name to passport

Answer: You cannot use older one in your maiden name. It was already invalidated when you applied for a renewal with name change after you were married.

If you want to revert back to your maiden name on your passport, you need to submit the most recent one (with your married name) for a renewal. You also need to submit the original divorce decree as evidence of legal name change.

The passport in your married name will be returned to you invalidated but with the stamps intact. You cannot have the stamps transferred to your new passport but you will still have them in the old ones.

However, many passport bearers who change their name continue to use their passports until they expire. If you choose to use your passport in your maiden name, you should book your flight in the same name. We also recommend you contact the airlines to confirm travel document requirements. If you choose to renew your passport and change your name, your new passport will be valid for 10 years from the date of issue.
